Hyprland Account Terms of Service

I. Definitions
Throughout this document, we use the following definitions:
- We - Hyprland Development, Hyprland Account developers and team.
- You - The user.
- Account - A Hyprland Account, registered on this website.
- Services - All services provided by Hyprland Account.
- Device - Any device you own that is running Hyprland Account-exclusive software.
II. Acceptance and Consent
By using, or accessing, the Account's features and services, you agree to be bound by these Terms of Service. If you do not wish to agree to this, or disagree with any part of the terms of service, you may not access these services and features. By agreeing to these Terms, you declare that you are at least 16 years of age, or have obtained explicit consent from your legal guardian.
III. What is a Hyprland Account?
The Account is a collection of services, some free, some paid, allowing you to enhance your Hyprland experience. This service is not necessary for Hyprland itself, nor does it provide any new core features to Hyprland.
IV. Usage
When using the Account, you agree to:
a) Appropriate use
When using our services, you must follow all applicable laws and regulations. You may not use our services for illegal activity. Additionally, you may not:
- Publish, or distribute, any of the files obtained through these services which are locked behind a subscription.
- Upload any files that are protected by copyright that you do not have rights to.
- Reverse engineer the code of any part of the services, unless another section allows you to do so.
- Attempt to damage, harm, or decrease the integrity of the services.
- Attempt to circumvent rate-limits or other security restrictions put in place within the services.
- Attempt to harm other users' experience of the services.
- Attempt to slow the service down.
- Create multiple accounts.
- Share, sell, or transfer your account to someone else.
- Encourage others to break these Terms of Service.
- Use names, aliases, or email addresses which contain offensive, vulgar, or otherwise explicit terms.
b) Interactions
Within our services, there may be instances where you may interact with other users, or upload your own content. In such cases, you must additionally:
- Follow etiquette and not disrupt the communications.
- Respect other users of the service.
- Whenever you see another user breaking these Terms, report them.
You must not:
- Spam.
- Advertise your products, services, or goods, unless you have explicit written approval from Hyprland Development, or another section allows you to.
- Submit any content that is malicious, such as computer viruses.
- Submit any content that is a placeholder, e.g. namesquatting.
- Submit any content that is disclosing information you do not have the right to disclose (e.g. others' personal information)
c) Account security
It is your sole responsibility to keep your account secure and your actions and login details private and confidential. If you are suspecting unauthorized use of your account, immediately contact support.
d) Suspension
We reserve the right to temporarily, or permanently, suspend your account if we find you in breach of these Terms. If the breach is not severe, we might send you a warning first. If you have any active subscriptions at the time of your suspension, we will refund your last monthly payment. After your account is suspended, you may not use our services anymore.
e) Further Terms
Each of our services may have their own additional Terms of Service which shall apply alongside these.
V. Payments
Some services are not free of charge. Payments for these are done through our payment provider, Stripe. All of your payment data is handled securely, according to Stripe's Terms of Service. All matters regarding to billing, payments, fees, subscriptions, refunds and disputes are handled through Stripe. We reserve the right to change any of the details of the subscriptions, offers and payments with a notice given beforehand within a reasonable timestamp (at least 14 days' notice). For all recurring purchases, you have a right to end your subscription at any point. Upon cancelling your subscription, you will lose the access to the Services after your last payment's access period ends. If it's your first recurring payment (usually 1 month), or if it's a singular purchase, you have a 14-day withdrawal period during which you can withdraw your purchase and get refunded in full. Monthly payments are automatic and handled by Stripe. You can cancel your subscription by going into your account, and cancelling it in the billing tab. You have a right to request a refund in case our Services are not delivered to you as described. All purchases carry with them local VAT/sales tax, and all prices shown are clearly stated to either already include tax or have tax separately (e.g. 5€ + tax). Tax will be calculated by Stripe at checkout. All donations are final and non-refundable. Donations are purely voluntary and are not required for any of our Services. Donations do not carry with them any VAT tax.

By using our services, you agree to the Privacy Policy.
VII. Liability
This service is provided "as is", with no guarantees of stability, continued operation or uptime. All of the services are used by you at your own risk. In no event shall we be held liable for any damages of any kind arising from the usage of this software, to the maximum extent allowed by applicable law. This does not include death or personal injury caused by negligence, or intentional misconduct or gross negligence. We will make a reasonable attempt to keep our Services operational, safe, and secure at all times, but due to the nature of the internet and software, this might not be always possible. The services might incur a downtime due to Force Majeure (war, cataclysms, etc.). You are responsible for how you use these services. You agree to not raise any legal disputes related to your breach of these Terms of Service. This agreement shall be governed by the applicable laws in Poland. All legal disputes shall be settled in a Polish court. Nothing in this clause shall deprive EU consumers of protections afforded under the law of their habitual residence. If any of the terms of these Terms of Service are unenforceable, these Terms shall apply to the fullest extent permitted by applicable law. This agreement, alongside potential other agreements on each of our Services shall be the only applicable agreements applicable to the use of our Services. These agreements supersede any prior agreements, understandings, negotiations or discussions, whether oral or written, regarding the Terms of Service.
VIII. Content
All the content you submit to our services is your responsibility. You agree not to wrongly imply any copyright with anything you submit to our services. Additionally, by submitting content, you give us the worldwide, non-exclusive, royalty-free, irrevocable right to process and publish it on our services, limited to operating our services. Others who access your public content may violate your licenses and you agree not to hold us liable for that.
IX. Intellectual property
All software related to the Services and the Services infrastructure itself are our intellectual property. We do not sell you software, we license it to you. You are not allowed to distribute or publish our software, unless we specifically allow it via license terms given to you with the software. You may tinker with it, modify it, and use it in a way that suits your needs, as long as you don't share it.
X. Changes to these Terms of Service
We reserve the right to change these Terms of Service at any moment. If the changes are purely editorial - we'll email you when they happen. If the changes are more broad - we'll email you 14 days in advance with an information about the new Terms. If you continue to use our services, that means acceptance of these Terms of Service. If you do not agree to the changes, you can ask us to delete your account without accessing the Services by emailing us at support [at] hypr [dot] land.
